ESPON started in 2002 and has continued since then, building a pan-European knowledge base related to territorial dynamics. 

In order to improve the efficiency and quality delivery of ESPON, an EGTC (European Grouping on Territorial Cooperation) has been established in 2006 according to European law to act as a Single Beneficiary for the ESPON Cooperation Programme.   

The ESPON EGTC is established in Luxembourg and has an Assembly composed of the three Belgian regions of Flanders, Wallonia and Brussels Capital as well as Luxembourg. The ESPON EGTC consists of permanent staff, temporary staff and trainees. 


The ESPON EGTC is recruiting a Legal advisor on Contracts and Public Procurement to join its international team working on European territorial evidence relevant for policy making.

The new staff member will be offered a permanent work contract and is supposed to take up the position as early as possible to support the implementation of the Single Operation financed by ESPON 2030 Cooperation Programme.

Description of the work responsibilities

As a Legal advisor on Contracts and Public Procurement you will be responsible for being the main source of competence in public procurement and contracting matters at the ESPON EGTC, providing legal expertise to ensure compliance of ESPON EGTC’s work with the rules of the ESPON Programme and with the relevant EU and Luxembourgish regulations and specifications.

Your key tasks will be following:

  • Provide strategic and ad-hoc advice and guidance to the Executive Management of the ESPON EGTC on compliance of the conducted works with the applicable legislation in public procurement, labour law and data protection.
  • Analyse challenges and drawing up feasible solutions based on the interpretation and application of regulations, specific guidelines and good
    practice corresponding to the organisation’s mandate.
  • Develop, monitor, review and amend a risk management and control strategy for the EGTC, including the implementation of anti-fraud measures.
  • Assist in the preparation and review of legal documents and contracts.
  • Carry out internal reviews and assessment of EGTC’s procedures in particular related with public procurement.
  • Provide guidance to the EGTC staff and management on legal compliance matters in public procurement, and contract administration and labour law.
  • Carry out compliance reviews on dossier filing in the context of the management of ESPON EGTC service contracts.
  • Co-drafting documents setting the ESPON EGTC’s staff-related policies and their operational framework (e.g. Staff Regulation and internal manual).
  • Support ESPON EGTC in disputes also before the Courts if and in case need.
  • Assume duties of the data protection contact person at the ESPON EGTC, including the responsibility for the update of the registries.
  • Assume the function of the Secretary of the ESPON EGTC Assembly: directly reporting to the Chair of the ESPON EGTC Assembly and its members in the
    setting and following-up of the ESPON EGTC Assembly meetings.
  • Provide legal support and advice on other tasks assigned by the Director/Assistant Directors related to the mission of the ESPON EGTC.



The legal and regulatory context for your work as Legal advisor on Contracts and Public Procurement are based on the relevant EU and national rules for public procurement as part of the European Structural Investment Funds 2021-2027 as well as Luxembourg legislation.

The post as Legal advisor on Contracts and Public Procurement will, in organisational terms, be under the responsibility of the Assistant Director on Budget, Administration and Public Procurement, but will report directly to the Chair of the Assembly.

 

Profile and experience required for the job position

Educational background and technical skills:

  • You hold a University degree in Law or equivalent. A Diploma or Certificate in Public Procurement will be considered as an advantage.
  • You have 7 years of experience in the field of public procurement and contracts (Applicants with less experience can be considered if they can demonstrate other relevant experience). Experience in particular in the Luxembourgish public procurement, labour and data protection law will be considered as an advantage.
  • You have good knowledge of EU public procurement law.
  • You are fluent in English and in French language to draw up written analyses and propose effective solutions based on the interpretation of the laws, regulations and specifications.

  • You have high sense of responsibility and initiative, to be able to pro-actively detect compliance risks and challenges, and work out remedial actions.
  • You have high ability to work independently, while demonstrating neat managerial approach to work organisation, structure and timelines, and being able to manage multiple tasks simultaneously and to prioritise.

  • You are a team player: reliable, supportive, self-motivated, he/she demonstrates a personal commitment and can easily integrate into a busy and active team.

Selection procedure

The ESPON EGTC will establish a Selection Board, which will invite the best-suited candidates for an interview and a practical competence test. The round of interviews is preliminarily scheduled in mid-September 2024 on-line. A second round on-site in Luxembourg will be considered. In that case, your travel and accommodation cost related with the interview will be reimbursed.

Conditions of employment

You will be offered a full time (40 hours/week) permanent employment contract (contrat à durée indeterminée).

A competitive salary will be offered to correspond to your experience and qualifications.

Your work place will be the premises of the ESPON EGTC at Avenue John F. Kennedy 11 in the Kirchberg area of Luxembourg City, in a multicultural environment close to European institutions and international schools.
