About the webinar

Good litigation management does not only entail considering the merits of a case and its probable success rate when deciding on initiating legal proceedings. It is most advisable to also look beyond and to consider if obtaining a judgment will benefit you anyway. Often claimants obtain a winning judgment, but still loose in the long run because their debtor is insolvent or has no seizable assets, or the judgment cannot be enforced for procedural reasons.

In view of the above we strongly believe that a judgment is merely a first step in resolving your dispute. The purpose of litigation is in principle not to obtain a judgment. The goal is to receive payment of all amounts due (in case the subject matter concerns compensation), also if the debtor has its assets cross-border.

In this one-hour webinar, we will provide answers to the following questions and more:

  • Can I enforce a foreign judgment in Belgium ?
  • Can I enforce a Belgian judgment in a different state ?
  • Can my debtor simply refuse payment after a judgment simply because the judgment was rendered in a foreign country different from his place of establishment?
  • Can I already proceed with conservatory cross-border attachments even if the matter is still pending before the court ?
  • Can I postpone execution as a debtor ?
  • How can I execute a foreign judgment in Belgium ?
  • Which types of attachments exist in Belgium ?
  • What types of attachments exist under European law and for which types of claims ?
  • Can you increase the chances to recover cross-border debts and if so, how ?
  • Are there ways to (contractually) escape such international enforcement of judgments?
