(Senior) Lawyer(s) for EU Law and Contractual Matters

The European Investment Fund (EIF) is seeking to recruit for its General Secretariat (GS) – Legal Service (LS) Department - Institutional Legal Affairs (ILA) Division, at its headquarters in Luxembourg, a (Senior) Lawyer(s) for EU Law and Contractual Matters. This is a full-time position (with limited travel requirements) at grade 4/5-5/6 (depending on experience) for which the EIF offers a permanent contract. 

Interviews via video-conferencing are anticipated for September 2024

This is a generic campaign in the view of addressing both current vacancies and to create reserve lists for future vacancies. Retention of the reserve lists will be for a maximum period of 18 months.

The General Legal Affairs (GLA) Unit is part of the Institutional Legal Affairs (ILA) Division and provides analysis and legal advice on matters relating to the legal needs of EIF, such as applicable EU laws and regulations, public procurement, contractual matters, inter-institutional relations and the litigation procedures involving EIF. You will assist the Head of Division and Head of Unit, together with other Lawyers within the team, in providing legal support to the other EIF Departments on matters of mutual interest always in accordance with the priorities established by EIF’s Secretary General.

You will be part of the GLA Unit and will report to the Head of Unit and the Head of Division. Under the supervision of the Head of Unit, you will coordinate your actions with the other divisions within EIF’s Legal Service and/or other relevant services. Subject to business needs and priorities, you may also be  assigned by the Head of Division to horizontal projects that are either within the remit of the team or that of other teams within the ILA Division.

At a level commensurate with seniority:

You will autonomously manage tasks  within the Division's scope, focusing on EU law, regulatory and institutional matters. The role requires versatility  in to seamlessly switch, between various assignments. 

You will in particular: 

• Draft agreements for securing EIF mandates, in particular EU structural funds under shared management from the Member States, according to the Common Provisions Regulation 1060/2021 and its predecessor 1303/2013, for financial instruments providing financing to SMEs;  
• Advise on EU regulatory provisions, in particular, the Financial Regulation 2018/1046 in connection with EIF mandates financed via EU budgetary resources; 
• Advise on State aid requirements in connection to EIF mandates from the European Investment Bank, European Commission or Member States; drafting relevant memoranda and legal opinions;
• Advise on various contractual matters with external parties, including Memoranda of Understanding (MoUs), other inter-institutional arrangements and EIF’s public procurement contracts with external suppliers;
• Advise on the application and interpretation of EIF's internal governance framework, including the EIF Statutes, as well as legal input on the implementation by EIF of best governance practices;  
• Advise on the regulatory matters involved by various European initiatives, such as the Recovery and Resilience Facility (RRF), InvestEU Programme.

• University Law degree, preferably at postgraduate level, in one of the EU Member States. 
• At least three (3) years for the Officer role and at least five (5) years for the Senior Officer role of relevant post-qualification professional experience in the field of EU law (EU regulatory, EU competition law - in particular State aid, EU budget implementation, relevant CJEU litigation), corporate law, commercial law and/or international arbitration, as relevant;
• Demonstrated experience of conducting legal negotiations, drafting contracts and internal memoranda in the areas under the GLA Unit’s remit;  
• Very good understanding of Civil law and Commercial law notions, as applied in various contracts;
• Any – or a combination – of the following would be an advantage:
  • Knowledge of both Common Law and Civil Law systems; 
  • Professional legal qualification in one of the EU Member States or under New York law (or another US jurisdiction);
  • Relevant experience in working with an international financial institution or an European Union institution/agency/body; 
  • Relevant experience in working in an international law firm; 
  • Experience in the implementation of financial instruments under EU budgetary rules (e.g. shared/indirect/direct management); 
  • Proven record in handling matters within different EU regulatory areas;
• Excellent knowledge of written and spoken English. Good command of French and/or other EU languages would be an asset; 

• Ability to identify controversial issues, provide sound legal analysis and develop innovative legal solutions;
• Excellent drafting skills; 
• Team player with ability to integrate in a multicultural environment;
• Solution-oriented and pro-active approach;
• Good interpersonal and negotiating skills;
• Ability to manage complex files and achieve a consensus among colleagues and third parties;
• Integrity.
